In a landmark announcement, a $4 billion (£3.1 billion) settlement has been proposed to compensate over two thousand individuals affected by last year’s devastating wildfires on Maui, Hawaii. Governor Josh Green confirmed that a deal in principle has been reached to resolve approximately 450 legal cases stemming from the August 2023 fires, which were the deadliest in modern U.S. history, claiming over 100 lives and obliterating the historic town of Lahaina.
The proposed settlement, detailed in a term sheet, stipulates a $4.037 billion agreement intended to fully settle all claims related to the Maui fires. Governor Green noted that this deal, reached after four months of intense negotiations, involves seven defendants named in the lawsuits filed in the aftermath of the fires. These defendants include the State of Hawaii, County of Maui, Hawaiian Electric, Kamehameha Schools, West Maui Land Co, Hawaiian Telcom, and Spectrum/Charter Communications.
Hawaiian Electric has agreed to contribute nearly $2 billion, which is just under half of the total settlement amount. The numerous lawsuits were filed by a mix of individuals, businesses, and insurance companies in both state and federal courts. Approximately 2,200 affected parties have lodged claims, seeking redress for the immense losses suffered during the catastrophe.
While the agreement represents a significant step towards justice and recovery, it is still preliminary and requires final approval from the courts and the legislature. Governor Green emphasized that the settlement is contingent on resolving the claims already paid by insurance companies for property loss and other damages, without any additional payments from the defendants.
Governor Green expressed optimism about the deal, highlighting its potential to expedite the healing process for the people of Maui. He stressed his commitment to avoiding prolonged and painful litigation, aiming instead for a swift resolution that would allow the community to begin rebuilding their lives without undue delay. “Settling a matter like this within a year is unprecedented, and it will be good that our people don’t have to wait to rebuild their lives as long as others have in many places that have suffered similar tragedies,” he said.
The proposed settlement, once finalized, will also require approval from Hawaii’s state legislature. Governor Green indicated that payments are anticipated to commence by mid-2025, providing a timeline for victims to start receiving the much-needed financial assistance.
