Denmark Publishes Emergency Grid Law That Puts Data Centers Last

Denmark Moves to Prioritize Limited Electricity Grid Capacity

Denmark is preparing to overhaul how new projects gain access to its electricity grid, placing greater priority on households, critical infrastructure and projects supporting the country’s electrification while pushing large and inflexible data centers toward the back of the queue.

The emergency plan comes as Denmark faces an unprecedented shortage of available grid capacity. Demand for new electricity connections has increased far faster than the expansion of the national grid, creating long waiting lists for companies and infrastructure projects seeking access.

Under the proposed system, grid connections would no longer rely mainly on a first-come, first-served approach. Instead, authorities and grid operators would be given greater power to decide which projects should receive priority based on their importance to Danish society and the energy transition.

Data Centers Face a Lower Position in the Queue

The most significant aspect of Denmark’s emergency grid plan is its treatment of large data centers.

Government officials have argued that the country’s limited electricity capacity should not be dominated by large, power-hungry and relatively inflexible projects while households, hospitals, defense facilities, transport systems and other essential services struggle to obtain the connections they need.

The proposed prioritization model would therefore place critical social functions, ordinary consumers and projects supporting electrification ahead of major data centers. Officials have specifically indicated that foreign-owned data centers could be placed toward the back of the queue.

The policy represents a major shift in how countries may begin responding to the rapidly growing energy requirements of the technology industry.

For years, governments have competed to attract data centers because of the investment they bring. Denmark’s approach suggests that electricity availability is becoming scarce enough to force policymakers to choose between competing types of economic activity.

Grid Capacity Has Become a Major Bottleneck

Denmark historically had sufficient electricity-grid capacity to support new consumers and industrial projects. That situation has changed rapidly.

The government says demand for new grid connections is now growing faster than planned grid expansion. Large electricity consumers, including data centers, Power-to-X projects and battery storage facilities, have created intense competition for available capacity.

The pressure became so severe that Danish transmission system operator Energinet temporarily paused new grid connection agreements earlier in 2026.

Energinet said applications for major new electricity consumption projects had reached a scale equivalent to several times Denmark’s existing peak electricity demand. The operator is expanding the grid at a historically rapid pace, but available capacity remains limited in the short term.

The problem is not expected to disappear quickly.

Some large projects could face waiting periods of between five and 10 years before gaining access to the grid, depending on location, capacity requirements and the development of new infrastructure.

First-Come, First-Served Model Is Being Replaced

Denmark’s traditional approach gave projects access to the grid largely according to when they applied.

The emergency legislation is designed to replace that model with a system that allows Energinet and electricity network companies to prioritize projects based on broader national and social needs.

The government has argued that scarce grid capacity should be used for activities that support everyday life, critical infrastructure and the country’s wider electrification goals.

Priority could therefore be given to areas including:

  • Households and ordinary electricity consumers
  • Healthcare and hospitals
  • Defense and critical infrastructure
  • Transport and charging infrastructure
  • Heating and energy supply
  • Businesses moving from fossil fuels to electricity
  • Renewable energy and projects supporting the green transition

Large projects that consume substantial amounts of electricity but offer limited flexibility could receive lower priority under the new approach.

The Rise of AI Is Increasing Pressure on Power Systems

The growing importance of artificial intelligence is making the electricity issue even more significant.

Modern AI systems require enormous computing resources, and those resources are concentrated inside data centers containing thousands of advanced processors and servers.

As AI companies race to build more powerful models, technology companies are investing billions of dollars in new computing infrastructure. That expansion is increasing competition for electricity and grid connections across the world.

Denmark’s grid shortage demonstrates how AI infrastructure is becoming more than a technology-sector issue.

The rapid growth of data centers can affect energy policy, infrastructure planning, industrial development and even national security. Governments may increasingly need to decide whether scarce electricity capacity should go to technology companies, manufacturers, households or strategic infrastructure.

The European Commission has also identified data centers as one of the major sources of unprecedented demand for new grid connections in Denmark, alongside Power-to-X and battery energy-storage projects.

Denmark Wants to Protect Its Green Transition

The emergency plan is not simply aimed at restricting data centers.

Denmark is attempting to prevent grid shortages from slowing down the country’s broader transition toward electrification.

Businesses are increasingly replacing fossil-fuel systems with electric alternatives. Transportation is shifting toward electric vehicles, while heating systems and industrial operations are also expected to consume more electricity.

If major data centers reserve large amounts of available capacity, other projects that directly support Denmark’s climate and energy goals could face long delays.

The government has therefore argued that grid capacity should be allocated according to national priorities rather than simply the order in which companies submit their applications.

This approach could allow Denmark to accelerate projects considered essential to the green transition while forcing other large consumers to wait until additional grid capacity becomes available.

Data Center Developers Could Face Longer Delays

For data center companies, the policy could create a more challenging investment environment.

Developers traditionally select locations based on several factors, including electricity prices, access to renewable energy, tax policies, connectivity and political stability.

Grid availability is now becoming equally important.

A company planning a multibillion-dollar data center may not be willing to wait several years for an electricity connection. If Denmark gives other projects higher priority, developers could redirect investment toward countries with more available power and faster connection processes.

This creates a difficult balance for Danish policymakers.

Data centers can generate investment, construction activity and technology-sector growth. However, they can also consume enormous amounts of electricity and place additional pressure on infrastructure that is already struggling to meet demand.

The emergency plan suggests Denmark is currently willing to prioritize broader social and economic needs over the immediate expansion of power-intensive computing facilities.

A Challenge for the Global AI Infrastructure Boom

Denmark’s decision reflects a challenge that is emerging across the global technology industry.

AI companies require rapidly expanding computing capacity, but building a data center is not simply a matter of constructing a facility and installing servers.

Developers need access to reliable electricity, transmission infrastructure, cooling systems and increasingly scarce locations near major power networks.

The result is a growing competition between AI infrastructure and other electricity consumers.

Countries that successfully expand their grids and increase power generation could gain an advantage in attracting technology investment. Countries with constrained networks may need to ration access or establish prioritization systems similar to Denmark’s.

The situation could also encourage technology companies to invest more heavily in their own energy infrastructure, including renewable generation, battery storage and long-term power agreements.

Grid Expansion Remains the Long-Term Solution

Denmark’s emergency law is designed to manage an immediate capacity shortage, but prioritization alone cannot permanently solve the problem.

The country will ultimately need continued investment in electricity transmission and distribution networks.

Energinet has already significantly increased the number of grid projects under development, with the value of planned infrastructure projects reaching close to 100 billion Danish kroner. Despite this expansion, the demand for new connections continues to exceed the capacity that can realistically be delivered in the near term.

The European Commission has also said Denmark’s grid capacity is likely to remain scarce in the medium term despite substantial investment, highlighting the need for faster infrastructure development, improved queue management and greater flexibility in the electricity system.

This means the emergency prioritization system could remain important even as new infrastructure is built.

Could Other Countries Follow Denmark?

Denmark may provide an early example of how governments could respond to the collision between AI growth and electricity constraints.

The technology industry has often assumed that sufficient infrastructure will eventually be built to support rising computing demand. But electricity networks require years of planning, regulatory approval and construction.

AI development, by contrast, is moving at an extremely rapid pace.

This mismatch could force more governments to intervene directly in decisions about who gets access to limited grid capacity.

Countries may begin prioritizing hospitals, defense facilities, housing, transportation, manufacturing or renewable-energy projects over large data centers.

Such policies could change the economics of AI infrastructure and influence where technology companies decide to build their next generation of computing facilities.

Denmark’s Policy Signals a New Era for Data Centers

Denmark’s emergency grid law highlights a fundamental change in the relationship between technology and infrastructure.

Data centers were once viewed mainly as investments that governments competed to attract. Now, their enormous electricity requirements are turning them into direct competitors with households, businesses and critical national infrastructure.

By moving data centers toward the back of the grid connection queue, Denmark is signaling that access to electricity can no longer be assumed simply because a company is willing to invest.

Instead, governments may increasingly treat grid capacity as a strategic resource that must be allocated according to economic, social and national priorities.

For the AI industry, the implications could be significant.

The continued expansion of artificial intelligence depends not only on better chips and more powerful models but also on the physical infrastructure needed to operate them. Access to electricity, transmission networks, cooling systems and suitable locations could increasingly determine where the world’s largest AI data centers are built.

Looking Ahead

Denmark’s emergency grid plan represents a direct response to a growing infrastructure problem: demand for electricity connections is rising faster than the country can expand its power network.

The proposed legislation gives grid operators greater authority to prioritize projects and moves away from a first-come, first-served system. Households, critical services, electrification projects and the green transition are expected to receive greater consideration, while large and inflexible data centers could be pushed further back in the queue.

The policy could make Denmark a case study for other countries facing similar pressure from AI and data-center development.

As computing demand continues to rise, governments will face increasingly difficult choices about how to allocate limited electricity resources. Denmark’s answer, at least for now, is clear: when the grid is full, data centers may have to wait.
