A US federal judge has temporarily blocked the Pentagon from enforcing its designation of Chinese biotechnology giant WuXi AppTec as a “Chinese military company,” ruling that defense officials repeatedly misread the evidence used to justify the label.
What the Judge Ruled
US District Chief Judge James Boasberg granted WuXi a preliminary injunction Friday, barring the Department of Defense from enforcing or otherwise giving effect to the designation while the company’s broader lawsuit proceeds. In a 35-page opinion, Boasberg wrote that “a scarlet letter sends a clear message: keep away,” pointing to customers and suppliers that had already cancelled contracts, ended long-standing relationships, or shifted business to WuXi’s competitors following the designation. A Pentagon spokesperson declined to address the ruling or say whether the department planned to appeal, citing a policy against commenting on ongoing litigation. WuXi AppTec did not immediately respond to a request for comment on the decision.
How WuXi Ended Up on the List
The Pentagon added WuXi AppTec to its Section 1260H list on June 8, 2026, formally designating it a “Chinese military company” operating directly or indirectly in the United States. The list, maintained under a provision requiring the Department of Defense to identify entities linked to China’s military-civil fusion strategy, included WuXi alongside other prominent Chinese firms with less obvious military connections, including automaker BYD and aircraft manufacturer Comac. Inclusion on the list does not automatically trigger sanctions, but it has historically discouraged American companies from continuing business relationships with listed firms given the reputational and compliance risks involved.
WuXi AppTec pushed back immediately and forcefully. In an open letter to customers signed by chairman and CEO Dr. Ge Li along with co-CEOs Dr. Minzhang Chen and Dr. Steve Yang, the company’s leadership called the designation “mistaken and baseless,” stating unequivocally that “WuXi AppTec is not a Chinese military company, not based on an objective review of the facts, and not under the statutory designation criteria for the Section 1260H list under U.S. law.” The company vowed to pursue every available legal avenue to correct what it described as an erroneous designation.
The Business Fallout That Followed
The designation’s real-world impact became a central piece of evidence in WuXi’s legal challenge. The company filed for a preliminary injunction after customers began suspending relationships and suppliers halted shipments in response to the listing, according to court filings. WuXi AppTec operates in more than 30 countries as a major contract research, development, and manufacturing organization, supporting global drugmakers throughout the drug development process. The company has highlighted its central role in the pharmaceutical supply chain, noting it supported the development of 8 of the 30 small-molecule drugs approved by the US Food and Drug Administration in 2025 alone.
Despite the designation and its disruptive effects, WuXi AppTec’s underlying business had continued performing strongly, with the company reporting total revenue of 12.44 billion yuan, or about $1.83 billion, in its first-quarter 2026 results, representing 39.4% year-over-year growth even amid the uncertain state of US-China relations.
A History of Near-Misses Before This Designation
WuXi AppTec’s relationship with US regulators and lawmakers had already been fraught well before this year’s Pentagon listing. The company was among five Chinese biotechnology firms originally named in the proposed BIOSECURE Act, legislation aimed at limiting Chinese biotech companies’ access to US federal funding and collaboration with American pharmaceutical companies. That bill passed the House in 2024 but stalled before becoming law, and when an updated version was ultimately enacted in October 2025 as part of defense authorization legislation, WuXi AppTec was notably absent from the final list of named companies of concern, a outcome widely seen as a win for the company’s investors at the time. The Pentagon’s subsequent addition of WuXi to the separate 1260H list in June 2026 effectively revived many of the same concerns that earlier legislative effort had raised.

With the preliminary injunction now in place, WuXi AppTec’s broader legal challenge to the designation will continue moving through the courts, leaving the company’s ultimate 1260H status unresolved even as it gains temporary relief from the practical business consequences of the listing.
